Contentious Probate Solicitors

Specialists in Inheritance and Trust Disputes

Contentious Probate is the term used to describe disputes relating to Wills, trusts and estates. These disputes can arise for several reasons, such as when the validity of a Will is questioned, when someone believes they have not received reasonable financial provision, or when disagreements occur during the administration of an estate (probate).

Regrettably, disagreements over a Will or estate management following the death of a loved one are not uncommon.

At Bowsers Solicitors, our experienced dispute resolution team advises beneficiaries, executors, trustees and family members on all types of inheritance and trust disputes. In addition, we can assist in defending against challenges to a Will or the distribution of assets.

Who Can Bring a Claim?

Only certain individuals are entitled to bring claims under the Inheritance (Provision for Family and Dependants) Act 1975, including:

  • Direct family dependants, including children or grandchildren.
  • A spouse, irrespective of whether they were still together or separated.
  • A person named as a beneficiary in an earlier Will.
  • A person who was financially dependent on the deceased.
  • A creditor who owns the deceased’s debt.
  • A person who believes that the deceased promised them an item, but this was not disclosed in the Will.

Other types of claims may arise where there are concerns about the validity of a Will, the conduct of an executor, or promises made during the deceased’s lifetime.

If you are unsure whether you have grounds to bring or defend a claim, we can provide advice at an early stage to clarify your options.

A Sensitive and Practical Approach

Inheritance and trust disputes frequently involve close family members and long-standing relationships. Our civil litigation lawyers draw on decades of experience to provide measured, practical advice and to pursue the most appropriate resolution for your circumstances.

Where possible, we aim to resolve disputes through negotiation or mediation. However, we are fully prepared to represent your interests through court proceedings if necessary.

Obtaining early legal advice can help protect your position and prevent unnecessary escalation.
